Personal data treatment and protection policy

Pursuant to art. 13 of Regulation (EU) 2016/679 ("GDPR"), MA Cycling Sport Srl, with registered office in Via Brenta, 112, 31050 VEDELAGO TV , Italy, VAT number 03863520262 (" MEM "), as Data Controller , provides this information on the processing of your personal data to illustrate the purposes and methods according to which your personal data are collected and processed, the categories of data concerned, your rights as an interested party and how they can be exercised. 

This information is valid only for this website (" Website "), MEM assumes no responsibility with respect to other websites that can be accessed via hypertext links on the Website.

By browsing the Site, users accept this Policy and are therefore invited to read it before providing any personal data.

  1. Data controller

MEM is the data controller (" Controller ") of the personal data collected through the Website.

For the performance of specific treatments, MEM makes use of employees, representatives and collaborators acting under its authority, as well as partner companies or professional firms that provide accounting, administrative, legal, tax or financial consultancy based in the European Union and duly appointed data processors pursuant to art. 28 of the GDPR.

The updated list of data processors and subjects acting under the authority of the Data Controller is kept at the Data Controller's headquarters.

  1. Categories of personal data

MEM  processes the personal data collected during the provision of services connected to the Site, the conclusion of the contract with MEM, as well as during the contractual relationship ("Data").

For example, the Data Controller collects the following categories of personal data:

  1. demographic data, such as name, surname, gender, place and date of birth, residential address;
  2. contact details, such as shipping address, telephone number and e-mail address;
  3. bank details (e.g. IBAN), if provided for a possible refund;
  4. navigation data, such as IP address, time of access to the site and/or registration on the platform, method of access to the server, server response code number (success, error, etc.);
  5. purchase data, such as country, date, product type and average monthly purchase value in the reference semester/year.

The Data Controller does not process data belonging to the particular categories referred to in art. 9 of the Regulation nor the data relating to criminal convictions and offences.

Your data is processed by MEM for the purposes specified in the following paragraph.

  1. Purpose and legal basis of the processing

MEM processes your data for the following purposes:

  1. for the execution of the contract

The Data indicated in paragraph 2, nos. 1-4, are processed by MEM in order to allow you to register on the Site and/and to use the services provided by it. For example, your data will be processed for the management of purchase orders, for maintenance and technical assistance, to improve the quality of the services provided through the Site or to update you on restocking dates. The data are therefore processed for the execution of the contract between you and the Data Controller.

The provision of data is necessary for the establishment and management of our contractual relationship; otherwise, we will not be able to perform the contract and provide the service in question.

  1. for marketing purposes

Direct sales

Unless you give your specific consent, MEM may process your Data for sending advertising or commercial e-mails relating to promotions or market research.

These e-mails can be sent both through automated systems (e-mail, SMS) and through traditional mail. To this end, the categories of Data concerned are those referred to in paragraph 2, nos. 1 and 2.

It is possible to withdraw consent at any time, even with reference to automated systems only, by writing to shop@memcycling.com

Soft spam

The data referred to in paragraph 2, n. 2, obtained as part of the sale of our products through the platform, can be used for the direct marketing of similar products. This treatment does not require your express consent pursuant to art. 130 of Legislative Decree 30 June 2003, no. 196, and subsequent amendments.

You can oppose this treatment at any time by following the instructions provided in each communication or by writing to shop@memcycling.com.

  1. for profiling purposes

MEM may process your data in order to understand your purchasing habits and preferences with respect to the products and services offered through the platform. This in order to offer you products and services in line with your profile.

For these purposes, MEM may process the data referred to in paragraph 2, nos. 1-2 and 5.

This data will be processed by MEM on the basis of its legitimate interest in perfecting the purchasing process and offering products and services that meet specific customer needs. MEM's legitimate interest has been duly balanced with your interests and expectations during the execution of a data protection impact assessment, which has established specific technical and legal measures in order to minimize the impact of the profiling your rights and freedoms.

We remind you that, pursuant to art. 21 of the GDPR, you can object to this treatment at any time for reasons relating to your specific situation, by writing to shop@memcycling.com.

  1. for the communication of your data to third parties for marketing purposes

If provided for by the Site and subject to your specific consent, MEM may communicate your data to third parties who will be able to process them for sending their own commercial communications via SMS and/or email.

The categories of recipients to whom MEM may disclose your data include, by way of example, subjects operating in the following sectors:

  • clothing, fashion, accessories, shoes, glasses, jewelry;
  • cycling, equipment, events, services, spare parts and the like;

The subjects to whom MEM will communicate your personal data will process such data as independent data controllers according to their own privacy policies.

To this end, the categories of Data concerned are those referred to in paragraph 2, nos. 1 and 2.

You can withdraw your consent at any time by writing to shop@memcycling.com

  1. Storage period and duration of treatment

Your data will be kept for the duration of the contractual relationship with MEM. Following the termination of this relationship, the Data will be kept for a period of 10 years exclusively for the purpose of allowing the Owner to assert his rights or fulfill his legal obligations.

With reference to the processing for marketing purposes referred to in paragraph 3(b), we inform you that your Data will be kept for the entire duration of the contract, unless you decide to revoke your consent or exercise your right to opposition.

With reference to the processing for profiling purposes, we inform you that your Data will be processed for up to 12 months or for the different period that should be provided for by law or by the Privacy Guarantor, unless you exercise your right to object. After this period or in case of opposition, your data will be kept if necessary for the pursuit of other purposes or will be definitively cancelled.

With reference to the disclosure of your data to third parties for marketing purposes, we inform you that your Data may be disclosed until you withdraw your consent.

  1. Disclosure for Law Enforcement

Under certain circumstances, MEM may be required to disclose your Data if required to do so by law or in response to valid requests by public authorities.

  1. Credit card information

MEM does not collect payment or other banking information directly from you because it is kept private by your banking system.

  1. Cookie data

MEM uses cookies and similar tracking technologies to track your activity on our website and retain certain information. For more information, read our  Cookie Policy .

  1. Rights of the interested party

We inform you that, pursuant to current legislation, you can:

  • request and obtain from MEM information about your personal data and your right to access such data;
  • as regards data processed with automatic systems, request that they be transmitted to another controller;
  • request and obtain from MEM the rectification of your personal data if you believe they are incorrect or incomplete;
  • request and obtain from MEM the cancellation - or limitation of processing - of your data if you believe that they are not necessary - or are no longer necessary - for the purposes indicated above, therefore after the expiry of the retention period indicated above.

Pursuant to current legislation, you may lodge a complaint with the Guarantor Authority for the protection of personal data for the alleged violation of your rights regarding the use of your personal data.

  1. Changes

MEM may change or simply update this privacy policy from time to time. You will be notified of any such changes or updates as they become effective.
